Is it ok to file economic hardship to start work before October; if subject is already approved for H1B? Since I am not in OPt status anymore.

You can still work under the interim law that was passed on around April 10th. You automatically can work citing the "cap gap" law that was passed. Show it to your company and work right ahead.

 

Thanks a lot for reply. I don't think cap gap rule will apply to me. Since I was in F1 status when I was approved for H1B. My OPt expired on January 2nd and I got H1b on April so I don't think cap gap rule will apply to me. So, I was thinking if I could apply for conomic hardship to start work before October.
