Hi Guys i have a doubt that we got married on December 2016 end of the year and my spouse filed a I 485 for me on 2017. now we are scheduled for an interview. in this process, we have filed tax separately (single) due to end of the year on 2016 we got married. we discussed with legal tax attorney and he said it will not create problem during interview time but i have a fear either i did a right or wrong and what should i give answer if officer ask why you file single during interview time.

I will be highly appreciate for your sweet answer.

Should be no problem, but you will have to put together a sh*t ton of evidence to convince the interviewer that your marriage is bona-fide since your husband filed your 485 only after a month of your marriage. Anything that shows that you had been in relationship for say 10 years. Anything that proves the authenticity of the relationship, not mere for sponsoring 485. May be your account is joint or you had been living together, bought a car together, etc. Hope this helps.

Thanks for the sweet comments. we know each other for a year and got married. yes we do have joint account, utilities bills apartment contract etc.

You didn't explain why you filed 'married but filing separately'. May be the real reason for which you filed separately is both legal and convincing. May be that, because you had lived and worked separately for almost the entire year, you thought it made more sense to file taxes separately. ....

If there was a legitimate reason, which you should know, I am not sure why you need to worry, even if the question comes up.

Yes we lived separate on 2016 and got married on end of the year so we have filed our tax as a single status on 2017. what you think, is it good to do so?

Go to IRS page and download 1040 instruction, you will get your answer as well helpful informations for your future filing.
