One of my friend filed asylum after staying about 15 month illegally, after finishing her OPT. she got graduated from US University. Is it possible to go to H1 or F1 from asylum status? Her asylum is not approved yet and still in process . Can any one help her find her options?
Any comments and suggestions are appreciated

Thank you All

did u say she was illegal for 15 months? then i think u will have to wait for the decision on her asylum. and why would u want to change your status to F1 or H1 when u already are in asylum?? if you want to study or work u can do after you get your asylum approval. Changing to F1 means u cannot work.

Once an asylum petition is filed, the applicant can file for an EAD Employment Authorization Card after 150 das. The card is issued regardless of your case status (if pending). The card is issued for one year and is renewable.
To work while your petition is pending, you have to have an EAD.
There is no need to change to F-1 or H-1.

Just curious, one of fren is in F1 for almost 4.5 yrs. I think she has visa till December '06.
As far as I know, she is so far legal meaning has not missed any semester ...Is it possible for her to file for asylum eventhough she has not gone back to nepal for 4.5 yrs?

Aslum should be filed within one year of entry to the US. Your friend may try going out of US (any country) and then coming back and apply for asylum, given the fact that she has reasonable evidence for applying asylum.
asylum is not granted for no reason. there has to be adequate reason of social persecution, fear of persecution, political threats, life threats, extortion etc. You may also wish to check readings in www.uscis.gov or www.anlus.wordpress.com for your help.
